New EEOC Posters on Way

The EEOC has just revised its “Know Your Rights” poster which covered employers need to post in a conspicuous place at the workplace and electronically, if possible, on the employer’s intranet.  The new poster improves on past models and uses plain language and bullet points. The EEOC touts it as a “win-win” for employees and employers since it makes it easier to understand rights and obligations.  The new poster also includes a few additions and clarifications:

  • Notes that harassment is a prohibited form of discrimination;
  • Clarifies that sex discrimination includes discrimination based on pregnancy and related conditions, as well as sexual orientation and gender identity;
  • It includes a QR code for fast digital access to the EEOC’s webpage explaining how to file an EEOC charge; and
  • It provides information about equal pay discrimination for federal contractors.

Generally, employers with 15 or more employees must display the new “Know Your Rights” poster. The Americans with Disabilities Act requires that employers ensure the poster is displayed in a location accessible to applicants and employees with disabilities that limit mobility or access.
